TERMS & CONDITIONS
In using this website (Site) you may provide your Personal Information* to Education Services Australia Limited (ESA). By using the Site you grant ESA consent to use your Personal Information in accordance with ESA’s Privacy Policy (see below) and acknowledge that these Terms and Conditions of use must be read in conjunction with ESA’s Privacy Policy.
* The Privacy Act (Cth) 1988 defines Personal Information to be "information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion."
Use of the Site is at your own risk. All express or implied warranties, representations, statements, terms and conditions relating to your use of the Site or any information or content available from the Site, not contained in these terms and conditions, are excluded from these Terms and Conditions to the extent permitted by law.
To the extent permitted by law, ESA excludes any liability it may have to you arising out of or in connection with this agreement or your linking to the ESA Site (including without limitation liability for loss of profits, loss of revenue, or loss or corruption of data).
If any condition or warranty is implied into this agreement under the Trade Practices Act 1974 (Cth) or any equivalent State or Territory legislation and cannot be excluded, then the liability of ESA is limited to one or more of the following:
(a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired;
(b) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.
You acknowledge that ESA may, in its sole discretion and with or without notice:
(a) vary the Site or any part of the Site; and
(b) modify or discontinue this Site, any part of the Site and the services available on it.
Event Registration
ESA reserves the right to alter an event, program or presenter(s) without further notice; however the program is intended to run as advertised. ESA reserves the right to cancel an event, program or presenter due to insufficient numbers - registrants will be notified if this occurs and payment refunded in full.
Registrations for events must be accompanied by full payment. Registrants will be liable for payment in the event of non-attendance unless cancellation or request for transfer is made in accordance with clause 3 below.
Cancellations or transfers must be advised in writing and received by ESA 5 working days prior to the activity. Refunds will not be granted if a registrant fails to attend a workshop, or cancels/transfers within 5 working days of the activity. Substitutions may be made at any time.
Third Party Pages
ESA is not responsible for any content found on a third party page, or any site of which it forms a part. You must determine whether any page is part of this Site each time you follow a link to that page.
ESA reserves the right to revise these Terms and Conditions. You accept all such revisions by accessing any part of the Site or continue to access it after that revision is posted on the Site.
This Site and any right or obligation under the Terms and Conditions is governed by the laws in force in the State of Victoria, Australia (other than the conflict of laws rules) and the parties submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia in respect of any action that arises under the Terms and Conditions.

The purpose of this Privacy Policy is to explain how ESA may collect personal information about you, and how ESA might use, disclose and handle that personal information.
Personal Information Collected when you use this Site
There are various ways in which Education Services Australia Limited may collect personal information.
Clickstream Data and Cookies
When you visit this Site the ESA server makes a record of your visit and logs the following Personal Information:

Emails and Electronic Forms
The Personal Information collected by ESA when you send ESA an email, will include your email address and may also include some of your Personal Information. In all cases and at all times, this Personal Information will only be used for the stated purpose for which it was provided.
ESA records your email address and Personal Information in the following cases:
- When you subscribe to any ESA publications.
- When you use ESA inform@esa.edu.au, email address to contact ESA.
- When you register to attend an ESA event.
Your Personal Information will not be disclosed to a third party, without your express consent.
Publication of your Personal Information
ESA will only publish Personal Information on this Site if it has been collected for this purpose with your knowledge, or if you have otherwise consented to the disclosure.

Security of your Personal Information
ESA takes all reasonable steps to ensure that the information (including Personal Information) ESA holds in ESA servers is not subject to loss, misuse or unauthorised access or alteration. ESA will destroy or permanently remove your Personal Information upon your request.
This Site does not, however, provide facilities for the secure transmission of information across the Internet. (For activities that require secure transmission over the Internet ESA uses a third party provider. This means that when purchasing from ESA your financial details are passed through a secure third party server using the latest 128-bit SSL (secure sockets layer) encryption technology. For example registrations and payments for ESA conferences and seminars are managed via a secure third party gateway.)
